Welcome to Watchland (the "App"), a mobile application operated by Bailong, a company based in Quebec, Canada ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the App, including any content, functionality, and services offered on or through the App.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. If you are under 18, you are prohibited from using the App.
Watchland is a platform that allows users to upload, share, and download custom smartwatch faces ("Watch Faces"). The App is provided on a free basis with advertisements, or through a premium subscription that removes ads.
All content uploaded to the App, including Watch Faces, text, images, and comments, is User-Generated Content ("UGC") created and provided solely by users like you. We do not create, endorse, review, or pre-approve any UGC.
Important: Watchland operates strictly as a passive platform and intermediary, facilitating the storage and sharing of UGC without exercising editorial control. We are not responsible for the accuracy, legality, or quality of any UGC.
As a passive host under applicable laws, including Canada's Copyright Act and Notice-and-Notice regime, we qualify for safe harbor protections and are not liable for copyright infringement by users, provided we comply with takedown notices as outlined in Section 10.
To reduce risks of infringement, users are encouraged (but not required) to upload only original, non-branded designs. We implement community reporting tools where users can flag potentially infringing content, which may trigger automated holds or reviews without our direct intervention, creating a self-regulating ecosystem.
To access certain features, you must create an account with a username, email, and password. You are responsible for:
We collect device IDs for security purposes. You may delete your account and associated data at any time through the App's settings.
By uploading UGC, you grant us a non-exclusive, royalty-free, worldwide license to host, display, and distribute your UGC solely for the purpose of operating the App.
You represent and warrant that:
Upon upload, you must affirmatively click to confirm ownership or rights to the content, which serves as a digital attestation that may shift evidentiary burdens in disputes. We do not verify these affirmations but rely on them for platform operations.
We reserve the right to remove any UGC at our discretion, but we have no obligation to monitor content.

The premium subscription is auto-renewing and billed via app store providers. You can cancel anytime through your app store account. Refunds are subject to app store policies.
We collect username, email, device ID, and photos (for UGC). For details, see our Privacy Policy.
Data is shared with third parties like Firebase and Google Analytics for app functionality and analytics.
The App and all UGC are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be error-free, secure, or uninterrupted, or that UGC will not cause hardware or software damage. Use at your own risk.
To the fullest extent permitted by law, including Quebec's Consumer Protection Act, our liability for any claims arising from the App is limited to the amount you paid for the premium subscription in the last 12 months (or CAD $10 if free user).

We respect intellectual property rights. If you believe UGC infringes your copyright, please send a notice compliant with Canada's Notice-and-Notice regime or the U.S. DMCA (for international users) to support@watchland.app.

Upon receipt, we will promptly remove or disable access to the allegedly infringing UGC. We may notify the uploader, who can submit a counter-notice. Repeat infringers' accounts will be terminated.
We implement an automated "flagging threshold" where content reported by multiple users is temporarily hidden pending review, without admitting knowledge of infringement, potentially qualifying for additional safe harbors under evolving case law.
You agree to indemnify, defend, and hold us harmless from any claims, losses, or expenses (including legal fees) arising from:

These Terms are governed by the laws of Quebec, Canada, without regard to conflict of laws principles. Any disputes shall be resolved in the courts of Quebec.
For EU users, we comply with GDPR dispute mechanisms.
We may update these Terms at any time. Continued use of the App constitutes acceptance of the updated Terms.
We may terminate your access to the App at any time for violations of these Terms.
